The Whitby Police Takedown Case has drawn renewed attention after an Ontario judge ruled that key gun evidence could not be used following a controversial police operation in Whitby that left one man seriously injured.

The incident occurred on June 25, 2024, near a Canadian Tire store in Whitby, where members of the Toronto Police Service were attempting to arrest Trayvon Palmer, who was wanted for allegedly breaching his bail conditions.

According to evidence presented in court, officers observed Palmer travelling on an electric scooter with Paul Lewis. During the operation, an officer driving an unmarked police vehicle interpreted a radio communication as an instruction to immediately stop the scooter. Surveillance video later showed the unmarked vehicle striking the scooter, throwing both riders to the ground.

Court proceedings revealed that the operation did not unfold as intended. After the initial collision, Palmer fled on foot while the officer pursued him through the Canadian Tire garden centre. Meanwhile, Lewis was struck again by another police vehicle after a firearm was seen falling to the ground during the incident.

Lewis sustained serious injuries, including spinal and rib fractures, and was transported to hospital for treatment. His legal counsel argued that the level of force used during the arrest was unreasonable and violated his rights under the Canadian Charter of Rights and Freedoms.

After reviewing the circumstances, the judge ruled that the gun evidence obtained during the incident would be excluded. As a result, Lewis was effectively acquitted of the firearm-related charges, with only a charge relating to an alleged bail condition violation remaining.

The Crown also withdrew the charges against Palmer.

The Whitby Police Takedown Case also resulted in criminal proceedings against Toronto Police Constable Joshua Baksh, who pleaded guilty to assault following an investigation by Ontario’s Special Investigations Unit (SIU).

In a statement, the Toronto Police Service confirmed that the officer continues to work in a non-public-facing position while any internal disciplinary matters remain pending until the criminal process is fully concluded.

The case has generated discussion regarding police tactics, the use of force during arrests, and the importance of ensuring law enforcement operations are conducted safely and within legal boundaries. It also highlights the role of the courts in reviewing police conduct and determining whether evidence obtained during an arrest can be admitted in criminal proceedings.

The Whitby Police Takedown Case remains a significant legal development and is expected to continue drawing public attention as related disciplinary matters move forward.
