Brock Street Culvert Replacement Project Officially Complete

The Township of Uxbridge has officially announced the completion of the Brock Street Culvert Replacement Project, bringing a close to a massive infrastructure initiative that has dominated local planning for decades. The municipality has now released the comprehensive financial disclosure for the project, marking the end of a process that included complex construction phases and subsequent legal negotiations. This initiative stands as the largest infrastructure project ever undertaken by the Township.

Awareness regarding the need to replace the existing culvert dates back more than 30 years, as the structure had deteriorated significantly over time. The pre-existing culvert was over a century old and failing, necessitating a major intervention to ensure the safety of those living, working, or travelling through the downtown core. Construction activities officially commenced in 2018, though the project remained open in the eyes of the administration until all outstanding legal and financial matters were resolved.

Following the physical conclusion of construction, several years of legal disputes persisted between the key stakeholders involved in the project. The disagreements involved the Township, the general contractor Brennan Paving & Construction Inc., and the engineer and contract administrator, AECOM Canada Limited. In 2021, the situation escalated when Brennan and AECOM initiated lawsuits against the Township, presenting a combined claim totaling approximately $8.75 million. In response to these actions, the Township filed a counterclaim of a similar magnitude against both Brennan and AECOM. Further complicating the legal landscape, AECOM also submitted a smaller claim directed against both the Brennan company and the Township, creating a complex web of litigation that required a formal resolution.

Efforts to resolve these disputes moved forward through mediation on January 16 and 17, 2024, where a framework for potentially settling the construction claims was established. After nearly two years of further processes, the settlement was finalized on December 24, 2025. Under the terms of the agreement, the claims made against the Township were settled for 5.26 per cent of the original amount sought. This resulted in a net cost of $460,000 to the Township, a figure intended to cover additional work that had been conducted by Brennan and AECOM. When accounting for the construction itself alongside the legal battles and required settlements, the total cost for the entire Brock Street Culvert Replacement Project reached $26,073,557.

Mayor Dave Barton remarked on the significance of the infrastructure update. “This is a major step forward for the Township,” says Mayor Dave Barton. “Replacing the culvert has lifted the majority of Downtown Uxbridge out of the floodplain, and completing this project allows us to advance our commitment to revitalizing that space, as seen through the ongoing initiatives of the Downtown Revitalization Project.” The successful replacement of the structure serves as a critical investment in the future of the community, ensuring the historic downtown area remains safe and accessible.

With the legal and financial aspects of the culvert project now firmly in the past, the municipal administration is concentrating its efforts on the broader redevelopment of the downtown area. The elimination of the floodplain designation for the majority of the downtown core opens new possibilities for economic growth and development. The Township is now fully focused on redeveloping the historic downtown district to benefit residents and business owners alike.

The finalization of the Brock Street Culvert Replacement Project removes a significant administrative burden from the Township, allowing staff and resources to be redirected toward future community improvements. As Uxbridge moves forward, the focus remains on building a safer and more resilient environment for the region, building upon the foundation established by this extensive infrastructure work.
